Offer Terms

 

This is a legal agreement that describes what we do for you and what you’ve agreed to do when you submit your information and/or gold to us.

These terms and conditions govern the transaction between you and Better Gold Prices, LLC  as "us", "we", "the company".  Unlike other sites, we are going to describe the legal aspects of how we work together as simply as we can. We believe by being upfront and honest in our dealings with you will earn your trust and you’ll refer us to your friends.

What we do:

We buy gold jewelry, personal items, coins etc. for the purpose of refining them and selling the metal content.  Our metals are refined at a refinery located in our facility in Aurora Colorado. 

How We Base Our Prices

We set our prices as a percentage of the spot gold price each week based on the last weeks average price for one ounce of gold (Valuation Formula).  When we receive your items, we determine the amount of pure gold in each item then give you a price based on our Valuation Formula.  If you send in items with high gold content you wil receive more money from us.  We reserve the right to change our formula at any time for any reason.  

Who Can Use Our Site and Services

No one under the age of 18 can use our site or services.  We never willingly buy gold from anyone under the age of 18 years old.  

By using our site, you are certifying that you are the rightful owner of the items that you mail us, that you are a US Citizen and that you are acting solely for yourself and you are not acting on behalf of another person (even a family member). 

Notice That Time Is Of The Essence In This Agreement

There are certain provisions in this agreement that are based on the timely action of either you or us.  Failure of either of us to perform certain actions in a timely manner may result in financial loss or a limitation of liability.  Please read this agreement carefully and pay close attention to the dates and times during which action is required.

 Requesting A Gold Return Kit

By requesting a gold seller's kit on our website or through our marketing partner's websites, you are agreeing to the Offer Terms included in this document and the Privacy Policy of the site you submitted your request to. 

You agree to provide your full name, a valid physical postal address, valid phone number and valid email address.  By providing a valid phone number you agree that we, or anyone we designate, can contact you by phone regardless of whether the number you provided has been placed on any federal, state, local other do-not-call list. You agree to hold us harmless and defend us if you provide any incorrect or false phone number or email address that becomes subject to a lawsuit or complaint for any reason.

You also agree that the email address that you provide may be used to contact you ourselves, or through marketing partners, or affiliates about this transaction or to provide information about other products or services that we or they deem valuable to you.  You may opt-out at any time by following the procedure in our privacy policy posted on this site or instructions in email from us or our marketing partners.

We may refuse to send a Gold Return Kit to anyone for any reason. 

Submitting Your Items To Us

You agree that you will only submit items to us for evaluation that contain at least 10% gold.  We do not accept costume jewlery or 'gold plated' items or items considered gold-toned or painted with gold or gold color. Also, please remove any stones that you do not wish to sell.  Upon Ownership Transfer as defined in this agreement, we dispose of any precious or semi-precious stones that are submitted with your gold. 

As part of the evaluation process, you agree that we may drill, use acid on, or disassemble any item that you have submitted to us.  You agree to hold us harmless for any damage during disassembly of your items.  We will not reassemble any item before sending it back to you.

Shipping Your Items To Us

You agree that when using the postage paid envelope to send your items to our processing center that the items are outside of our care and control until they arrive at the processing center.   If you are sending items that are extremely valuable, please insure them before mailing them.  Or, you can use UPS, FedEx, DHL, Airborne or other domestic carrier to arrange for shipping and insurance if you wish.  

If your items are lost before we receive them and you can provide proof of mailing we will reimburse you for your loss up to the limits of liability in this agreement. 

Before you send your items you agree to clearly identify them on the Item Inventory form included in your kit and to return the Item Inventory form in your shipment to us.

Receiving Your Items

The date of receipt for purposes of this agreement shall be the later of the date you shipped the items to our processing center or the date we received them.

Any package that is visibly damaged when it arrives at our processing center may be rejected and returned to the carrier. We will not be responsible for items lost in transit between you and us if the packaging is torn, damaged or appears to be tampered with.  All claims for loss, damage, theft or tampering with your package in transit, must be filed with the carrier and not with us.

Upon receipt of your items, we will inventory them, checking to make sure that the items you claim were in your package actually arrived.  If we find any items that are shown on your Item Inventory that are not in the package we will send a notice with your offer check.  If you do not wish to accept our offer for the gold content in the items we did recieve, you may request them back per our Item Returns Procedure.  

Offer and Payment

Upon evaluation of your items, we will mail an offer check to the address submitted with your items, if different from the address submitted when you requested your Gold Return Kit.  The check amount will be based on the gold content of your items as determined by our Valuation Formula.  At your request, we may issue a supplemental check to increase our original offer to you. 

If for any reason your offer check is lost or misplaced you can request a replacement for up to 7 years from us.  After 7 years the funds due to you are transferred to the State of Colorado.  

Ownership Transfer

You agree that any item(s) sent to Better Gold Prices is sent with the understanding that ownership of the items will pass automatically and irrevocably from you to us  IF 1.) you accept our offer of payment for your gold, either verbally, in writing or by email, or 2.) you cash any check for full or partial payment of your gold items submitted to us, or 3.) you fail to arrange for the return of your items within 30 days of the date we receive them.

You agree that, even if you have never received a check from us, if you have not requested a check or requested that we return your items within 30 days of recipt of your items, our offer based on our Valuaton Formula to you will be considered acceptable and final payment for your items.   

Item Returns

In the event you do not receive an offer from us, or our offer is not acceptable to you, and you wish to retain ownership of your items, you must arrange for them to be returned to you within 30 days of the date we originally received them. 

In order to obtain your items, you must act before the expiration of the 30 day period and you must either have your designated carrier pick up your items from our processing center, in Aurora, Colorado during 9-5 Monday through Friday, or, make payment of $19.95 per ounce to us to ship your items via uninsured first class mail for you.

In the event of loss during transit for any reason, you agree that our liability to you or  your carrier shall be limited in accordance with the limits of liability as defined in this agreement. 

Failure to make a request and pay us to handle shipping and processing or to make a request and have your carrier pick up your items by the expiration of the 30 day period shall result in ownership of the items transfering from you to us per the Ownership Transfer provision of this agreement. You further agree that our liability for disposing of the items after 30 days for any reason shall be limited to no more than the limits of liability defined in this agreement.

Limitation of Liability

You expressly acknowledge and agree that our limits of liability to you shall be the lessor of 1.) $100.00 or 1/3 of the appraised value of your items, provided that said items were appraised by a Certified Gemologist prior to their submission to us, or the amount of our offer to you, in instances where were have evaluated your items.

You agree to hold us harmless and to indemnify us regarding any other losses or damages, including but not limited to any incidental, consequential, indirect, special, punitive damages,or loss of profit or opportunity; claims, actions or demands for any subrogation claim brought by your insurance carrier or transportion carrier, and by submitting an item or items to us, and you specifically and expressly waive any such subrogation claim on your own behalf as well as on behalf of your insurance carrier. By sending your items to us, you explicitly and expressly accept this limitation of liability.

If you believe your gold jewelry and/or other items are worth more than One Hundred U.S. Dollars ($100.00), we recommend that you insure your shipment for more at your own expense using any transportaion carrier you choose. We also encourage you to request return of your items if you are not satisfied with our offer, if you do not recieve an offer or if you are unable to complete your transaction in a timely manner.  This Limitation of Liablity shall apply to any and all claims under the Ownership Transfer provision of this agreement. 

This limitation of liability shall be binding on you and any third party, including, but not limited to, your successors, assigns, estate, insurance carrier and any other individual or entity asserting any right or claim relating to your transaction with us.  In no event shall we be liable for any damages from the loss or destruction of property in our possession for any reason, including negligence, except as stated herein. In no event shall we be liable to any third party or any insurance carrier.
